PARTICIPATION AGREEMENT & RULES
THIS IS AN AGREEMENT BETWEEN YOU AND THE ADCAP CHALLENGE in connection with your use of THE ADCAP CHALLENGE's proprietary materials and services, including but not limited to the AdCapChallenge.org website, the AdCap Challenge Finalist Experience, the AdCapYOUth.org website, the AdCap Challenge kits, and other program materials and resources (collectively "the AdCap Challenge"), to design and create a submission entry. The AdCap Challenge is a program provided by GENYOUth, a 501(c)3 organization with support of sponsors (Challenge Partners).
BEFORE DOWNLOADING OR UPLOADING ANY CONTENT FROM OR TO THE ADCAP CHALLENGE WEBSITE, YOU SHOULD READ THIS AGREEMENT CAREFULLY. BY DOWNLOADING OR UPLOADING ANY CONTENT FROM OR TO THE ADCAP CHALLENGE, YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THIS AGREEMENT.
YOU MAY USE THE ADCAP CHALLENGE IF YOU ARE AT LEAST 13 YEARS OF AGE. HOWEVER, YOU MUST BE AT LEAST 18 YEARS OLD TO ENTER INTO THIS AGREEMENT. IF YOU ARE UNDER 18 YEARS OLD, YOU MUST HAVE A PARENT OR LEGAL GUARDIAN CAREFULLY READ AND GRANT PERMISSION FOR YOU TO ENTER THIS AGREEMENT.
By submitting an entry, each team member and any adult advisor(s) acknowledges that he/she has read and hereby agrees to the rules and regulations of the AdCap Challenge as listed here.
THE ADCAP CHALLENGE: This team-based, national competition is for students ages 13-18 to use their creativity and talent to answer questions presented by Challenge Partners.
ELIGIBILITY: In order to participate in the AdCap Challenge a teacher or staff member (“Challenge Advisor”) at a school must have an account on AdCapChallenge.org. The Challenge Advisor is responsible for organizing student teams to participate in and create a submission for the AdCap Challenge. A team is defined as 3-5 students ages 13-18 who attend an accredited U.S. school. Student Teams submitting an entry for Level 2 to compete for the Finalist Experience must have at least 2 members and a Challenge Advisor available to travel to Newtown Square, PA on June 12-14, 2019. Student teams submitting only a Level 1 entry are will not be entered into the competition, but will receive recognition for participation.
DEADLINE FOR SUBMISSIONS: Student team submissions must be entered to AdCapChallenge.org by 11:59 PM Eastern time on Thursday, April 25, 2019. Late or incomplete submissions will not be accepted.
SELECTION OF SEMIFINALISTS: Level 2 entry submissions will be reviewed by a panel of judges to identify up to 100 semifinalists. Submissions will be evaluated based on the following criteria (as defined below):
- Innovation (30%): Uses a new or unique process, device, or idea
- Creativity (30%): Shows imaginative problem-solving techniques, execution, presentation, or use of resources (including leveraging existing resources)
- Feasibility (20%): Has a high likelihood of working as presented, is practical to execute, or will have a high adoption rate among its intended audience
- Reach (10%): Has the ability to have a positive effect on a large number of people, relative to the resources it requires
- Clarity (10%): Is fully developed and well-communicated, including writing skills, organization of information, and cohesiveness
The judges' decisions are final, including interpretation of the rules and criteria. Participants may not make appeals or complaints against the judges, organizers, or sponsors of the Challenge.
SELECTION OF FINALISTS: Up to 25 semifinalists will be asked to participate in a video or phone interview with a panel of judges in order to identify up to Finalist Teams. Up to 5 finalist teams will be selected by a panel of judges appointed by the AdCap Challenge. Finalists Teams must agree to have at least 2 members and a Challenge Advisor attend the FINALIST EXPERIENCE on June 12-14, 2019 in Newtown Square, PA. The final winner will be determined through a series of scored challenges and final presentations. Any winnings are non-transferable and all federal, state and local taxes are the sole responsibility of winners. All federal, state and local laws and regulations apply.
Finalist Teams must be available for publicity and promotional purposes during and for a reasonable period after the Challenge competition - including media interviews with newspapers, radio and TV. The AdCap Challenge and Challenge Partners may provide the media with each winner's details, photographs and/or video footage for publication or broadcast.
INTELLECTUAL PROPERTY RIGHTS: All Submitters release ownership of all intellectual and industrial property rights (including moral rights) in their Submissions. The AdCap Challenge, including GENYOUth, sponsors, agencies, and partners have full and unlimited rights to use and share submissions.
"Submission" means an entry consisting of the original concept material submitted to the AdCap Challenge by the Submitter. "Intellectual Property" means copyrights, design rights, patents, designs, registered designs, trademarks, service marks (or an application for any of these), inventions (whether patentable or not), invention disclosures, discoveries, improvements, processes, test and qualification processes, schematics, specifications, formulae, procedures, proprietary information, know-how, technology, trade secrets, technical data, works of authorship (whether copyrightable or not), mask works, software (in source code and object code forms), databases, data collections, and documentation and all copies and tangible embodiments of any of the foregoing throughout the world in whatever form or medium.
Representations and Warranties: Submitter represents and warrants that the Submission including all content and material used in the Submission is the original work of the Submitter.
Representations and Warranties Regarding Third Party Intellectual Property: The Submitter represents and warrants to Sponsors and Organizer that Submitter has not submitted any Submission that infringes any third party proprietary rights, intellectual property rights, industrial property rights, personal or moral rights or any other rights, including without limitation, copyright, trademark, patent, trade secret, rights of privacy or publicity, or confidentiality obligations of another.
Other Representations and Warranties: Submitter represents and warrants that:
- The Submission does not violate applicable federal, state, or local laws; and
- The Submission has not been entered in previous contests or won previous awards; and
- The Submission has not been published or distributed previously in any media; and
- The Submission does not contain any claims that are not and cannot be substantiated or that would be false and/or misleading.
RELEASE: To the maximum extent permitted by the law, the Submitter hereby releases, waives and forever discharges sponsors and organizer and any of their respective affiliates, officers, employees, members or agents of and from any and all claims, obligations, debts, causes of action, and liabilities whatsoever.
CONSENT: By entering the Challenge and/or accepting a prize at any level, participants grant permission to sponsors and their agencies to use winners' names and/or likenesses for advertising and/or trade purposes without further compensation unless prohibited by law.
The Submitter hereby consents to use of the Submitter's name, images, photo, city, state, likeness, Submission and prize information worldwide, in perpetuity, for all purposes (including advertising, marketing, promotion, in any media outlet including wireless/mobile devices and the exploitation of any and all ancillary and subsidiary rights) and the same may be edited, in all media now known or hereafter created, throughout the world, without limitation and without payment or consideration, except where otherwise required by law. The Submitter additionally consents to the release of all Personal Data collected by the Organizer and the Organizer's agents, to the Sponsors.
INDEMNITY: To the maximum extent permitted by law, the Submitter agrees to defend, indemnify and hold harmless the Sponsors and the Organizer, and their affiliates and their respective directors, officers, employees and agents from and against any and all claims, actions, suits or proceedings, as well as any and all losses, liabilities, damages, costs and expenses (including reasonable attorneys' fees) arising out of or accruing from (a) any act, default or omission on the part of the Submitter; (b) Submitter's breach of any warranty set forth herein; (c) any material uploaded or otherwise provided by the Submitter that infringes any copyright, trademark, trade secret, trade dress, patent or other intellectual property right of any person or defames any person or violates their rights of publicity or privacy, (d) any misrepresentation made by the Submitter in connection with the Challenge; (e) any non-compliance by the Submitter with the Rules applicable to the Challenge; and (f) claims brought by persons or entities other than the parties to this Agreement arising from or related to the Submitter's involvement with the Challenge or use or acceptance of any prize or prize-related activity including any responsibility for travel or accommodation associated with the Challenge.
LIMITATION OF LIABILITY: The AdCap Challenge, the sponsors and organizers accept no liability for any claims arising in connection with the AdCap Challenge. In no event shall the AdCap Challenge sponsor or the organizer be liable for any loss of data, lost profits, business interruption, or other special, incidental, consequential, punitive, indirect, or speculative damages under any legal theory (including negligence and strict liability).
CHANGES: The AdCap Challenge organizer may, at its discretion, make changes to participation rules and this agreement, including but not limited to dates and deadlines, websites and resources, and recognition of submissions. Challenge Advisors will be notified by email of changes.
